1. Eligibility

Solobo Toys Summer Giveaway Series – Beaches Resorts Autism-Friendly Caribbean Family Vacation (the "Sweepstakes") is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Solomon Boss, LLC also known as Solobo, prize providers and other companies associated with the promotion of the Sweepstakes, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Sweepstakes is subject to federal, state, and local laws and regulations.

2. Sponsor

The Sweepstakes is sponsored by Solomon Boss, LLC also known as Solobo, located at 11815 Fountain Way Suite 300, Newport News, Virginia 23606. The Sweepstakes prize will be provided by Unique Travel, Corp. (“Unique”) a Panamanian Corporation located at Calle Aquilino De Guardia, No. 8, Panama, Republic of Panama, the worldwide representative for Beaches Resorts.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a Caribbean Family Vacation ("Prize") is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.

4. Sweepstakes Period

The Sweepstakes begins on July 22, 2024 at 9:00AM MT and ends on August 30, 2024 at 11:59PM MT (the "Sweepstakes Period"). Entries that are submitted before or after the Sweepstakes Period will be disqualified. Submissions will be accepted for the duration of the Sweepstakes using any of the following methods: Online only.

5. How to Enter

Online: This method of entry will be available by visiting our website (www.solobotoys.com) and following the directions provided to fill out the entry information and submit.

Limit one (1) entry per person, per email address, and per household for the duration of the Sweepstakes Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Sponsor and will not be acknowledged or returned.

6. Prize Drawing

On or about September 02, 2024, the Sponsor will select a potential winner in a random drawing from among all eligible entries received. The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner via telephone or email on or about September 06, 2024. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.

7. Winner Notification

The potential winner will be notified by email, mail or phone. The potential winner will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her Prize. If a potential winner cannot be contacted or fails to submit the Declaration of Compliance within the required time period (if applicable), or the Prize is returned as undeliverable, potential winner forfeits Prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the Prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable Prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the Prize will remain un-awarded.

8. Prize

Unique will provide the Prize as follows: 

1.1 One (1) Prize consisting of a four-day/three-night all-inclusive vacation for two (2) adults and 2 children (ages 15 and under) in a Deluxe/Luxury category room to any one of the Beaches Resorts listed below located in Turks & Caicos and Jamaica (the “Beaches Resorts Prize”) – subject to the terms and conditions herein and the additional terms and conditions in section 13 below.

1.2 Airfare is not provided by the Sponsor nor Unique.

1.3 Beaches Resorts are:

• Beaches Turks & Caicos - Providenciales, Turks & Caicos
• Beaches Negril - Negril, Jamaica
• Beaches Ocho Rios - Ocho Rios, Jamaica

1.4 Average Retail Value of the Beaches Resorts Prize = 3,636.00 USD.

9. General Conditions

In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Sweepstakes is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Sweepstakes and, in the event of termination, award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

10. Release and Limitations of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, Unique and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Sweepstakes, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the "Released Parties)" from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the Prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Sweepstakes, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Sweepstakes; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Sweepstakes-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Sweepstakes or acceptance, receipt or misuse of the Prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the entrant be entitled to receive attorney's fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

11. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Virginia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of Virginia, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Virginia.

12. Privacy

Use of Personal Data/Personal Information: Entry into the Sweepstakes constitutes the Participants’ representation of eligibility, consent to participate and consent for the Sponsor to obtain, use and transfer your name, telephone number, mailing address, email address and other information obtained through the entry for the purpose of the Sweepstakes administration and Prize redemption. The Sponsor’s Privacy Policy is available here https://solobotoys.com/policies/privacy-policy and the Beaches Resorts Prize Provider’s Privacy Policy is available here https://www.Beaches Resorts .com/general/privacy/. All Participants who “opt-in” to receive future communications from the Beaches Resorts Prize Provider regarding marketing promotions, special savings and event notifications about Beaches Resorts. Participants who “opt-in” will have the ability at any time to opt out of receiving any future marking promotions or events.

13. The Beaches Resorts Prize Additional Terms and Conditions:

1. Beaches Resorts are all-inclusive Caribbean Resorts for Families.
2. The Beaches Resorts Prize will include (one (1) room, quad occupancy in a deluxe/luxury category, all meals, unlimited Premium Liquors, daily & nightly entertainment, an array of land and water sports activities, including daily Scuba diving (for certified divers), snorkeling, Wi-Fi in all rooms and public areas, access to the Kids Camps, resort gratuities, resort taxes, and Beaches transfers to and from the selected or designated airport.
3. “Exclusions” – Airfare, car rental, personal charges, incidentals, telephone calls, Premium Wi-Fi, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, room services, meals outside of the selected or designated resort, island departure taxes, purchases made at the Beaches Specialty or Gift Shops, baggage fees, customs duties, and travel insurance are not included.
4. The Beaches Resorts Prize will be issued in the form of a prize certificate (“Prize Certificate”) outlining the terms and conditions of the prize and redemption procedures.  
5. Beaches Resorts Prize must be redeemed for travel within one (1) year from the date on the Prize Certificate (the “Redemption Period”) and is not transferable or redeemable for cash.  No extension will be given after the Redemption Period has expired. If the Beaches Resorts Prize is not redeemed, the prize will be forfeited.
6. The Beaches Resorts Prize is subject to space availability and selected blackout dates. Reservations will not be confirmed until 30 days prior to the selected travel date. Confirmation of travel dates will only be provided 30 days prior to the departure date.
7. Any federal, state and/or local taxes applicable to Beaches Resorts Prize will be the prize winner’s responsibility to pay. The prizewinner will receive from Solomon Boss, LLC or its designee an IRS Form 1099 (or similar) in the amount of Average Retail Value of the Beaches Resorts Prize.  
8. Substitution of Resort: Unique Travel Corp – the Beaches Resorts Prize Provider and/or Beaches Resorts each reserves the right to substitute the selected resort for another resort in the resort’s chain in a similar category, and to change dates without prior notice for any circumstance(s) so require or beyond the resort’s control based upon availability for the secured travel dates. The terms and conditions agreed to shall apply with equal applicability to any resort which is the subject of substitution or deviation. Neither Unique Travel Corp nor Beaches Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.
9. Compliance with Government Entities.    Unique Travel Corp, its affiliates, and parent as well as Beaches Resorts and/or Beaches Resorts related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of the Agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.
10. Health and Safety: Beaches Resorts reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.
11. CLASS ACTION WAIVER:   ACCEPTANANCE OF THE BEACHES RESORTS PRIZE PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT AS A RESULT OF THIS AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST UNIQUE TRAVEL CORP – THE BEACHES RESORTS PRIZE PROVIDER WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. - TERMS AND CONDITIONS AVAILABLE HERE https://www.beaches.com/terms-conditions/ THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS. GUEST AGREES THAT THE PARTIES REFERENCED IN FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE UNIQUE TRAVEL CORP. – TERMS AND CONDITIONS THAT MAY BE THE SUBJECT OF ANY CLAIM BY GUEST CAN RECEIVE IMMEDIATE JUDICIAL ASSISTANCE TO ENFORCE THIS CLASS ACTION WAIVER.
12. Travel Safety Warning:  All guests are responsible for checking the travel and entry protocols for the destination that they are traveling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, for some destinations, may require guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre and post travel.   The prizewinner is advised to visit the travel.gov website before travel and to check the official Government website for the country visiting. The Beaches Resorts Package provider shall not be responsible for any additional costs incurred for any required test or any other pre-travel requirements.
13. Winner List: To request the name of the winner, send a self-addressed, stamped envelope to Solomon Boss, LLC 11815 Fountain Way Suite 300 Newport News, VA 23606.
